1. Acceptance of Terms

• You represent and warrant that:

  3. Your User Content complies with these Terms and all applicable laws and regulations.
• You agree not to upload, post, or share any User Content that:
  1. Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
  2. Infringes upon any intellectual property right or other right of any party;
  3. Contains software viruses or any other code designed to disrupt, damage, or limit the functionality of any computer software or hardware;
  4. Violates any law, regulation, or contractual obligation.

4. Intellectual Property Rights

• All content on our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of SurTaal or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.
• Our name, logos, product and service names, designs, and slogans are trademarks of SurTaal. You may not use such marks without our prior written permission.
• We respect the intellectual property rights of others and expect users of our Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.

5. Subscription and Payments

• Some of our Services may require payment of fees. By subscribing to these Services, you agree to pay all fees in accordance with the applicable subscription plan.
• All subscription fees are non-refundable unless otherwise specified or required by law.
• We may change our fees at any time by posting the changes on our website or notifying you directly. Continued use of our Services after such changes constitutes your acceptance of the new fees.

6. Limitation of Liability

• To the maximum extent permitted by law, SurTaal, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
  1. Your access to or use of or inability to access or use our Services;
  2. Any conduct or content of any third party on our Services;
  3. Any unauthorized access, use, or alteration of your transmissions or content.
• In no event shall our total liability to you for all claims exceed the amount you paid to us, if any, during the past twelve (12) months.

7. Indemnification

You agree to indemnify, defend, and hold harmless SurTaal, its directors, officers, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you or any activity related to your account (including negligent or wrongful conduct).

8. Termination

• We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
• Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of our Services following the posting of any changes to these Terms constitutes acceptance of those changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Mumbai, India, for the resolution of any disputes.
